Although Dept notes detailed analysis of proposed constitutional amendment will follow by despatch, we would appreciate telegraphic comment following points:
1. We note from UPI despatch datelined Seoul May 11 that “under law, 30 days must elapse between formal announcement of a constitutional amendment motion and action by the Assembly. When bill comes up for vote, it must be accepted or rejected as submitted. There can be no changes without another 30-day waiting period.” In this connection what would constitute an amendment to the proposed constitutional thereby beginning another 30-day waiting period? We note you indicate that although substantially in excess of 2/3rds Assemblymen have signed amendment, there still possibility constitutional amendment may not be approved at termination initial 30-day waiting period. We pressure this because possibility amendments may be offered to the amendment at end 30-day period. We wonder whether this procedure possibly could be used by incumbent National Assembly as stalling tactic.
2. Are Addenda 1) integral part of proposed constitutional amendment 2) separable from amendment but requiring 2/3 vote for passage 3) subject same vote ordinary legislation, could Addenda be debated over extended period as stalling tactic?
3. Since Addenda provides that senior member State Council incumbent at time promulgation will be regarded as Prime Minister, would Huh’s tenure carry beyond election now House of Representatives or would new Prime Minister be nominated by President when new House of Representatives comes into being?
4. Since present House of Representatives would be given light under proposed Addenda choose first President after promulgation amendment would appreciate your estimate whether Rhee might be elected President for 5-year term.
5. Would appreciate your preliminary assessment as to whether constitutional amendment and Addenda as now constituted will meet requirements situation and satisfy basic and justifiable grievances Korean people which led to overthrow Rhee regime.
